General terms and conditions for using FrameGo's platform
1. Over view
Welcome to FrameGo, an on-demand marketplace platform that connects clients seeking visual content creation services with professional photographers and videographers ("Creators"). These Terms of Service ("Terms") govern your use of the FrameGo platform, including our website, mobile applications, and related services.
FrameGo Technologies Inc. ("FrameGo," "we," "us," or "our") operates as a technology platform that facilitates connections between independent Creators and clients. We do not provide photography or videography services directly but enable transactions between users of our platform.
By accessing or using FrameGo, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms.
2. Key defenitions
"Platform" - The FrameGo website, mobile applications, and related technology services
"Creator" - Professional photographers, videographers, and content creators who offer their services through the Platform.
"Client" - Users who book and pay for visual content creation services through the Platform.
"Booking" - A confirmed arrangement for Creator services made through the Platform.
"Content" - Photos, videos, and other visual materials created during a Booking.
"Services" - Photography, videography, and related visual content creation services.
3. Acceptance of Terms
By creating an account, accessing, or using the Platform, you acknowledge that you have read,
understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the
Platform.
These Terms constitute a legally binding agreement between you and FrameGo Technologies Inc. Your continued use of the
Platform following any changes to these Terms constitutes acceptance of the revised Terms.
4. Our Services
FrameGo provides a technology platform that enables:
Discovery and booking of professional photography and videography services
Real-time location tracking and communication tools
Secure payment processing and fee management
Review and rating systems for quality assurance
Dispute resolution and customer support services
FrameGo acts as an intermediary platform and is not a party to the contractual relationship between Creators and Clients for the
provision of visual content creation services.
5. Eligibility Requirements
To use the FrameGo Platform, you must:
Be at least 18 years of age
Have the legal capacity to enter into binding agreements
Maintain the confidentiality of your account credentials
Comply with all applicable local, state, and federal laws
Additional requirements apply to Creators, including professional qualifications, insurance requirements, and background verification as outlined in the Creator Terms section.
6. User Accounts
You are responsible for maintaining the security of your account and all activities that occur under your account. You must immediately
notify FrameGo of any unauthorized use of your account or any other breach of security.
You must not:
Create multiple accounts or false accounts
Your account credentials with others
Use another person's account without permission
Sell, transfer, or assign your account to another party
7. Booking Terms
When you make a Booking through the Platform:
You enter into a direct contractual relationship with the Creator
FrameGo facilitates the transaction but is not a party to the service agreement
All Bookings are subject to Creator availability and acceptance
Cancellation and refund policies apply as outlined in our Payment Terms
Rescheduling is subject to Creator availability and may incur additional fees
Important: FrameGo does not guarantee the quality, safety, or legality of services provided by Creators. Clients book services at their own
discretion and risk.
8. Payment & Fees
Payment for services is processed through the FrameGo Platform:
Clients pay the total booking amount including platform fees upfront
FrameGo charges a 4% platform fee to Clients
FrameGo retains a 15% service fee from Creator earnings
Payment to Creators is released upon service completion
Refunds are processed according to our cancellation policy
Comply with local laws and regulations regarding commercial photography
Cancellation Policy
More than 24 hours before booking: Full refund minus processing fees
Less than 24 hours before booking: 50% refund
No-show or cancellation after start time: No refund
9. Creator Teams
As a Creator on the FrameGo Platform, you agree to:
Provide professional-quality Photography or videography services
Maintain appropriate professional licenses and insurance
Arrive on time and fulfill all Booking commitments
Deliver final content within agreed timeframes
Maintain professional conduct and behavior
Use FrameGo's real-time tracking system during active Bookings
Professional Requirements: Creators must provide proof of professional experience, maintain liability insurance, and pass
background checks before platform approval.
10. Client Terms
As a Client using the FrameGo Platform, you agree to:
Provide accurate booking information and requirements
Be present and available at the scheduled time and location
Treat Creators with respect and professionalism
Comply with location-specific photography restrictions
Pay all fees promptly through the Platform
Provide honest and constructive feedback through our rating system
Content Ownership: Unless otherwise agreed, Clients retain rights to visual content created during their Booking, subject to Creator
attribution requirements.
11. User Conduct
You agree not to use the Platform to:
Violate any applicable laws or regulations
Harass, threaten, or discriminate against other users
Post false, misleading, or fraudulent information
Circumvent platform fees or payment systems
Interfere with Platform operations or security
Create content that is illegal, offensive, or inappropriate
Infringe on intellectual property rights of others
Violation of these conduct standards may result in account suspension or termination and legal action where appropriate.
12. Intellectual Property
The FrameGo Platform, including all software, designs, text, graphics, and other content, is owned by FrameGo
Technologies Inc. and protected by intellectual property laws.
Regarding content created through the Platform:
Clients retain ownership rights to visual content from their Bookings
Creators retain artistic and professional attribution rights
FrameGo may use content for marketing purposes with user consent
Users grant FrameGo a license to use content for platform operations
13. Privacy & Data
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect,
use, and protect your information.
By using the Platform, you consent to:
Collection and use of your data as described in our Privacy Policy
Location tracking during active Bookings for safety and service purposes
Communication with other users through Platform messaging systems
Sharing of relevant information with Creators or Clients for service delivery
14. Limitation of Liability
To the maximum extent permitted by law, FrameGo shall not be liable for:
Indirect, incidental, special, or consequential damages
Loss of profits, data, or other intangible losses
Damages arising from user actions or third-party conduct
Quality, safety, or legality of services provided by Creators
Technical failures or interruptions of the Platform
Important Disclaimer:
FrameGo provides a platform service only. We do not control or guarantee the quality,
safety, or legality of services provided by independent Creators.
15. Indemnification
You agree to indemnify and hold harmless FrameGo Technologies Inc., its officers, directors, employees, and
agents from any claims, damages, or expenses arising from:
Your use of the Platform or services
Your violation of these Terms or applicable laws
Your interactions with other users
Content you create, upload, or share through the Platform
Any disputes between you and other users
16. Account Termination
FrameGo may suspend or terminate your account at any time for:
Violation of these Terms or our Community Guidelines
Fraudulent or illegal activity
Multiple complaints or poor performance ratings
Failure to maintain required insurance or licenses (Creators)
Extended inactivity
Upon termination, your access to the Platform will cease, but these Terms will continue to apply to your prior use
of the Platform.
17. Dispute Resolution
For disputes arising from Platform use:
Contact FrameGo support for mediation assistance
Engage in good faith negotiation with the other party
If unresolved, disputes will be subject to binding arbitration
Arbitration will be conducted under the rules of the American Arbitration Association
You waive the right to participate in class action lawsuits against FrameGo.
18. Governing Law
These Terms are governed by the laws of the state of California, United States, without regard to conflict of law
principles. Any legal proceedings must be brought in the state or federal courts located in San Francisco
County, California.
19. Changes to Terms
FrameGo may modify these Terms at any time. When we make changes:
We will update the "Last Updated" date
We will notify users via email or in-app notification
Material changes will require explicit user consent
Continued use after changes constitutes acceptance
